March 31, 2021The United States Congress recently passed the third round of Stimulus checks, and many are wondering if their pending (or settled) Divorce case will have any effect on their eligibility to receive one.
Here are some common questions and concerns regarding Stimulus Checks During Divorce:
Stimulus Check During Divorce: Who Will Receive It?
The check will be deposited into the bank account listed on your previous tax return with the IRS. Please contact your local family lawyer to explore your options if your most recent tax return was a joint return with your spouse.
Child Custody Case: Will This Affect Who Receives the Dependent Tax Credit?
The check will be made out to the person who filed as head of household. Please contact your divorce attorney to discuss your options if you filed jointly with your spouse and listed your minor children on your tax return, or if your custody situation has changed since the return was filed.
Child Support Case: Will I Receive a Stimulus Check?
The standard child support laws continue to apply. In Florida, the Child Support Program at the Florida Department of Revenue is expected to report past-due child benefits to the US Treasury. As a consequence, your check can be intercepted in whole or in part and given to the custodial parent to be added to the outstanding balance.
