Driver can hold their phone while driving and talking
There is one exception to this general rule starting October 1st. Drivers can hold their phone while driving and talking except within a school zone or an active work zone.
The law applies to texting while actually driving
The new Florida texting and driving law does not apply to drivers who are stopped at a traffic light. However, you may be cited for impeding traffic if you fail to stop texting after a light turns green (ie: distracted driving).
Using a device for GPS while driving is allowed
Although you can’t text and drive, you may use your mobile device for GPS and getting directions. Applications such as Google Maps, Apple Maps, or Waze are okay.
Driving while taking photos or videos does not apply
Though the law does not prohibit the use of a mobile device to take photos or videos while driving, you could be subject to other traffic violations.
Drivers are not required to hand over their device
When a driver is pulled over for allegedly texting and driving, the officer must inform the driver of their right to refuse a search of the mobile device. The officer is not allowed to search a driver’s mobile device without a warrant or consent from the driver. If, however, the driver is involved in an accident that results in fatalities or injuries, the driver’s phone records can be obtained by authorities as evidence in the investigation.
