No Fault State – Injury Law

Does no fault state mean no settlement?

Jonathan Diamond of Jodat Law Group explains no fault state as it pertains to Florida injury law.

After an accident in a no-fault state, such as Florida, the insurance automatically pays for the damages regardless of fault. This amount and/or limit is specified in the policy. Because you are guaranteed a payment for damages, you have to give up your rights to file suit against the other driver. Medical payments and property damage are typically paid out regardless of fault.

No-fault insurance has the purpose of reducing auto insurance premiums across the board by reducing the number of accident/injury cases that go to trial, by restricting recovery for pain and suffering damages, and by providing limited payment for losses.
